EU Court Ruled out Sales of Piracy-Configured Media Players

The European Court of Justice has decided that selling devices pre-configured to obtain unauthorized content is against the law. This ruling evolved from a case between the well-known Dutch anti-piracy group BREIN and a shop selling piracy-configured media players. The industry experts believe that this ruling will have far-reaching consequences across the European Union, especially for those selling piracy-enabled Kodi boxes.

The piracy-configured set-top devices are extremely popular today: mostly running Android, they often have pre-loaded software like the neutral Kodi platform augmented with third-party plugins designed to receive the latest movies, TV shows or live sports as easy for the user as possible.

The Netherlands-based online store Filmspeler.nl was one of many stores selling such devices, but it was unlucky to be targeted by BREIN. The store’s owners believed that the pre-configured devices were legitimate, since their sale did not amount to a “communication to the public” as said in the EU Copyright Directive.

2 years ago, the Dutch District Court referred the case to the EU Court of Justice, asking it to decide whether it’s illegal to sell a product with pre-installed plugins containing hyperlinks to websites from where copyrighted content can be streamed without permission. Later, Advocate General issued his recommendation to the Court, pointing out how Filmspeler owner knowingly added infringing software to Kodi devices and even advertised its media players as ways to watch content without paying.

As a result, the European Court of Justice said that a media player with pre-installed software provides users “direct access to the protected works published without the permission of the copyright owners” and therefore constitutes communication to the public.
